1. Who you are dealing with
notbeloser.com (“the Service”) is operated by Enrico Antonacci, an individual trader. You can reach us at dev@2devstudio.com.
Payments are handled by Polar. Polar Software, Inc. (3500 South DuPont Highway, Dover, DE 19901, USA) acts as Merchant of Record and authorised reseller for every order placed on this site: it buys the listing from us and resells it to you. Polar processes the payment, issues the invoice and collects any applicable taxes. Your contract of purchase is therefore with Polar, and their Buyer Terms apply in addition to these terms.
2. What you are buying
You are buying a position on a public leaderboard, and nothing else. The amount you pay is your score. The listing with the highest total sits at the top. There is no algorithm, no editorial judgement and no assessment of merit or quality.
We do not promise visitors, clicks, customers, attention, or any outcome whatsoever. The only thing you receive is your row on the board, displayed with the name, description, link and photo you provide, for as long as the Service exists.
3. How ranking works
- Entry starts at €1. Amounts are whole euros, up to €999999.
- The first 10 listings may join at €0. A €0 listing ranks below every listing that has paid.
- Your payments accumulate into a running total. That total is your rank.
- If two listings hold the same total, the one created first ranks higher.
- To climb, you pay only the difference between your total and the total you want to reach. Nobody else can add money to your listing.
- Your total never expires and is never reduced. It is a floor, not a balance: it cannot be withdrawn, transferred, or spent on anything other than your own rank.
4. Payments, refunds and your right to cancel
Positions are delivered immediately: the moment your payment is confirmed, your listing appears on the board with its new total.
If you are a consumer in the European Union or the United Kingdom, you normally have 14 days to withdraw from a distance contract. Because this service is delivered instantly, at checkout you are asked to expressly request immediate performance and acknowledge that you lose that right of withdrawal once the listing is live. If you do not give that consent, the purchase cannot be completed.
Beyond that, payments are not refundable: being overtaken by another listing is the normal working of the Service and is not a defect. This does not affect your statutory rights where the Service is faulty, unavailable, or not as described. Refund requests are handled by Polar as Merchant of Record — see our Refund Policy.
5. What you may put on the board
You must be at least 18 years old. You may only submit your own name, your own photograph and a link you are entitled to promote. You may not impersonate anyone, submit another person’s image or details, or link to content that is illegal, sexual, hateful, deceptive, or harmful.
We may remove any listing that breaks these rules, or that exposes us or Polar to legal risk. Where we remove a listing for a breach by you, no refund is due. Where we remove it for our own convenience, we will refund the amount you paid for it.
6. Availability
The Service is provided as it is. We do not guarantee it will be uninterrupted or that it will exist indefinitely. If we decide to shut it down permanently, we will say so on this site at least 30 days in advance. We do not owe compensation for amounts already spent, which buy a position for as long as the board runs and not for any fixed period.
7. Liability
To the extent the law allows, our total liability to you is limited to the amount you have paid in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profit or lost opportunity. Nothing here limits liability for death, personal injury, or fraud.
8. Law
These terms are governed by Italian law, and the courts of Italy have jurisdiction. If you are a consumer, you keep the protection of the mandatory rules of the country where you live.
9. Changes
We may update these terms. The date at the top shows the current version. Changes are not retroactive: the terms that apply to a payment are the ones published when it was made.
